Terms of Service
Effective Date: July 1, 2026
1. Who we are and what this covers
obzervai.com is owned and operated by Cosmos89 LLC ("obzervai.com", "we", "us"). We provide AI assisted tools that help educators turn classroom observation notes into professional reports aligned to educational frameworks.
These Terms are a contract between you as an individual user and Cosmos89 LLC. You accept them on your own behalf. You are not accepting them on behalf of your school, district, or employer unless you are separately and expressly authorized to bind that organization.
2. When a school or district agreement controls
If your school, district, or employer has signed a separate written agreement with Cosmos89 LLC covering your use of obzervai.com, including any data privacy agreement, that agreement controls over these Terms wherever the two conflict. These Terms continue to apply to everything the signed agreement does not address.
Order of precedence, highest first:
1. A signed district or school data privacy agreement, including any state required exhibit.
2. A signed order form, contract, or purchase order.
3. These Terms and Conditions.
4. Any other policy or documentation we publish.
3. Your account
- You must provide accurate information when you create an account.
- You are responsible for keeping your login credentials secure and for activity under your account.
- Accounts are for a single named person. Do not share an account.
- You must be an educator, administrator, or other authorized staff member of an educational organization.
4. Acceptable use
You agree to:
- Use the service only for legitimate educational observation and evaluation purposes.
- Minimize student personally identifiable information in your observation notes. Do not enter student information beyond what your organization's policies permit.
- Not share your account, attempt to disrupt or reverse engineer the service, or upload unlawful content.
- Comply with your own organization's policies on evaluation records and student data.
5. Observation data and ownership
Default, individual accounts. You own the observation notes and source content you enter. We do not claim ownership of it.
School and district accounts. Where your school, district, or employer has signed an agreement with us, that organization owns and controls the observation notes, generated reports, and related records created under its account, and we handle that content as its agreement directs. In that case your individual rights to export or delete content are subject to your organization's instructions.
What we do with it. We process your content to operate the service, generate reports, and maintain your history. We do not sell it. We do not use customer observation content to train artificial intelligence models, and our AI providers are contractually prohibited from doing so.
Service data. We may use aggregated and de-identified information that cannot reasonably be linked to you, your students, or your organization to operate, secure, and improve the service.
6. What the service does and does not do
We provide AI assisted report drafting, access to observation frameworks and templates, hosted storage, and customer support by email and phone.
We do not guarantee uninterrupted availability, that generated output is accurate or complete, or that the service satisfies any particular district's evaluation requirements.
Human review is required. Our output is a draft for a qualified human evaluator to review, correct, and approve. obzervai.com does not make and must not be used to make an automated employment or personnel decision. Responsibility for the content and use of any final evaluation rests with you and your organization.
7. Trial, pricing, and payment
Free trial. New individual accounts may start a free trial as described on our pricing page. The trial is limited in duration and in the number of reports that can be generated. No payment card is required to start a trial. The trial does not automatically convert to a paid plan. When the trial ends, access to paid features stops until you choose a plan and enter payment details.
Paid plans. Current plans and prices are published on our pricing page and are incorporated into these Terms by reference. School and district licenses are invoiced.
Renewal and cancellation. Paid plans renew automatically at the end of each billing period until cancelled. We disclose the renewal term and price before you subscribe, and you may cancel at any time from your account settings, effective at the end of the current billing period. Partial periods are not refunded except where required by law.
Price changes. We will give at least 30 days notice by email before a price change takes effect for your plan.
School and district plans. Priced by agreement, normally annual, and governed by a separate order form and district agreement.
8. Communications
We will send you transactional messages about account security, billing, service changes affecting your account, and support. These are part of the service and cannot be opted out of while your account is active.
Marketing email is optional and every marketing message includes an unsubscribe link.
We may use your phone number to contact you about support. We do not send text messages.
9. Intellectual property
We own the obzervai.com platform, software, models and prompts we develop, templates, branding, and site design. We grant you a limited, non exclusive, non transferable right to use the service during your subscription. You own your content as set out in section 5.
10. Security and incidents
We maintain administrative, technical, and physical safeguards appropriate to the data we handle, including encryption in transit and at rest, access controls, and logging.
If we confirm a security incident affecting your personal information or your organization's data, we will investigate and contain it, notify affected users and any affected organization without unreasonable delay and no later than 72 hours after confirming the incident, describe what happened and what we are doing, and notify regulators where the law requires it. Where a signed district agreement sets a shorter or more specific notification requirement, that requirement controls.
11. Term, suspension, and deletion
You may cancel at any time from your account settings. We may suspend or terminate an account for breach of these Terms, and we will give 30 days notice before closing an account for non payment.
You can export your content at any time while your account is active. After account closure we delete your content within 30 days, except where we are required to retain records by law or where a signed district agreement specifies a different deletion schedule.
12. Disclaimers and liability
The service is provided "as is" and "as available" to the fullest extent permitted by law. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim. Neither party is liable for indirect, incidental, or consequential damages. Nothing in this section limits liability that cannot be limited by law, and these limits do not apply where a signed district agreement provides otherwise.
13. Changes to these terms
We may update these Terms. For material changes we will email account holders at least 30 days before the new version takes effect and will ask you to accept the new version in the product. Non material updates, such as a change of contact details, will be posted with a new effective date. Every published version is retained and dated.
14. Disputes
Support first. Contact support@obzervai.com. Most issues are resolved there.
Individual users. These Terms are governed by the laws of the State of Connecticut, without regard to conflict of laws rules, and the state and federal courts located in Connecticut have exclusive jurisdiction. To the extent permitted by law, claims are brought individually and not as part of a class action, and any claim must be brought within one year of the event giving rise to it.
Public educational institutions. The preceding paragraph does not apply to a public school district, charter school, or other government entity. Governing law, venue, and dispute resolution for those customers are set by the signed district agreement, and where that agreement is silent the law of the customer's state applies.
